My situation is that my company is having layoffs and I want to have an option under my bucket
If I convince my employer to transfer me to India and let my PERM continue: will anything be impacted on PERM side (My employer will file I-140 as well): with me being in India, will I-140 filing be an issue?
Any expert advice will be greatly appreciated
PERM and i140 can be filed irrespective of your physical location.
You can be in India while both continue.
Also, you can even work for some other company and PERM and i140 can still be filed. No issues.
My H1B max out is next year July so switching company and filing everything again will not be ideal
I think my only option is to convert myself into Indian payroll with the same company while my perm and i-140 is continued so that I dont hinder the process
My concern was that if my perm and i-140 gets impacted if I try to convince my employer to convert me into Indian Payroll
