Can my mom leave US without doing biometrics while B2 Extension is pending?

Did you cancel visa extension?

Yes. I checked with USCIS and they told me to keep all the documents and notices for record in case required for future entry into the country. And they told me we can withdraw our petition to extend the stay.

Hi Anil if we leave before biometrics should be write to uscis to inform them or withdraw the case or we just leave?

You can withdraw the application once you have left the US so that USCIS knows that you don’t need it anymore.

I filled B2 visa extension for my mom in April 2020. We got the receipt number in 2 days after filling the application. She left from US in August 2020.there was no update on her case till January 2021. In February we got an email for biometric appointment, but I ignored it . Then today I got email that her extension is rejected .
Will this create a problem when she re-enters US ?

I suggest to email the embassy and check if USCIS has also not cancelled your mother’s visa stamp.

Normally, due to COVID-19, they are not cancelling visa but there is no harm in checking.

I did send an email to USCIS 2 days ago , but there is no response from them . I tried calling their customer service but you can never talk to a real person on that number .
I am worried , what should I do next ?

  1. I do not know how things have changed during this pandemic. I would send them certified withdrawal letter of the petition to the service center, along with the following documents.
  • Ticket/Boarding pass copy
  • Copy of biographical page of passport
  • Copy of entry stamp in new country
  • i94 page showing exit
  1. For next visit, keep the same above mentioned documents along with withdrawal letter, receipt notice (any other notices), biometric appointment letter and I-539, handy.

Based on what I have seen and read, Attorney suggests doing 1 and 2 while USCIS suggests doing 2. It’s at your discretion what you want to do.

You should email the US embassy which issued the visa to check if visa is still valid or not.

USCIS is different than US embassy.

Unfortunately I did not withdraw my mom’s extension application. I just got the denial for the extension application. Should I still send the documents to USCIS ?

Got it. I missed ‘denial’. So the 2nd option holds good for next visit (subject to valid visa).

I had applied B2 extension for my mother in law on 03/20/2020 and she left USA on 09/10/2020 before getting Biometric appointment. Have received Biometric appointment letter on 09/12/2020. I have sent a letter to USCIS informing that my mother in law left USA and she will not be able to attend biometrics, including her receipt notice and then got the denial letter on 04/06/2021 due to missing biometric appointment and then case was reopened by USCIS on 04/07/2021 and then it is on reopened status till now. Do I need to send withdrawal letter to USCIS now or Do I need to wait for the case result?

I’m also in a same situation my mother left US to India on May 29, 2021. We applied B2 extension in February, 2021. Today 3rd July, 2021 We received biometric appointment notice. What should I do please suggest.

  1. my Mum could not leave US due to covid
  2. We filed for extension
  3. received a biometrics Appointment
  4. The travel started before the appointment so she left the US to go back to India
  5. We did not withdraw the case
  6. Received a Denial and the letter states they denied it because their records show she departed US
  7. Now my Mom is in UK and wishes to travel to with us to back to US
  8. How can we identify if the existing Visa stamp on her passport is still valid or she needs to go back to india and re-apply for a new Visa al together.

Denial of B2 extension of status do not impact the B2 visa. If her B2 visa is still valid she can travel to the US.

Unfortunately my Mom missed biometrics appointment too… now she is in india and willing to travel again … we are worried if she could travel again ! And how long do they accept her ! … when she arrives here … please let us know if your Mom is back with you …
