I am currently filling up the DS-160 for my H1B re-stamping. My employer is currently processing my green card and I have received approved I-140. In the DS-160, there is a question “Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services”. Should I mark it Yes or No.
I believe that it is “Yes” and planning to state the Alien Beneficiary number in the box below. Please advise. Appreciate your response

You have to say ‘Yes’ for this question on DS160 form as your employer has filed an i140 for you.

You have to say “employer has filed i140 application”.

Thanks for ur prompt response. But I have already got dropbox confirmation letter means submitted the application. Since its a drop box how to fix this.

You can fill a new DS160 and request the person at dropbox window to attach the new one your application.

They may or may not do it.

I have an approved I-140 and I am planning to mark it as YES. Also last year, my H1 transfer was approved however, I did not join them and continued with my current employer.

Should I need to mention about the approved petition? Need advise please…

Your new employer petition need not be mentioned as they would have withdrawn it.

In that case can I just mention the Ref # of I-140’s (One from my present employer and the other from my previous employer) ?

Hi Anil, my situation is as below:

  1. I am applying for H4 visa stamping (Dropbox)
  2. Spouse has i-140 approved
  3. I have expired H4-EAD card

What should my answer be in DS-160 for below questions:

  1. Has anyone ever filed immigration petition on your behalf with USCIS?
    Yes / No
  2. Update your US-SSN and US- taxpayer ID number
    Should I update my SSN and ITIN issued for H4-EAD?

I have an approved I-140 with my employer. My wife is on H4. When my wife is filing for her DS-160, for the question “Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?”, should she answer ‘YES’ or ‘NO’ for this question?

For H4 , you can answer ‘No’.

Thank you. So if my wife and kids have been mentioned in my I-140 form in PART 7 while filing, in this case also I need to put as ‘No’?

I have approved i140 from employer A, I moved to employer B and I am now with employer C.
I am planning to go for stamping and filling the DS160.
What I should answer to the question “Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?”
